The employer did violate the Canada Labour Code...

Attached is the recent award from the CIRB regarding bargaining unit work. As you will read we were successful in our application and we are reviewing it in its entirety. We will offer further comments in the following days. A small excerpt is written below.
The Board has determined that, by using management to perform bargaining unit work when unionized crews were available, the employer did violate sections 36(1)(a) and 94(1)(a) of the Canada Labour Code (Part I-Industrial Relations) (the Code).
We would like to thank Brother Finnson and Denis Ellickson of Caley Wray for his assistance and support throughout this long process and hearing. Also, we would like our members from Red Deer who testified on a moment’s notice and played a significant role in the results achieved.
Translation of the Board Order will be sent out as soon as we get it. We will provide further updates with respect to the Board order and numerous related grievances.
